OVERVIEW
This website is operated by Big Dave's Cigars. Throughout the site, "we," "us," and "our" refer to Big Dave's Cigars. These Terms of Service, together with the policies linked on our site, govern your use of the website and purchases from us. By using the site or placing an order, you agree to these Terms.
AGE REQUIREMENT AND VERIFICATION
You must be at least 21 years old to access the online store, purchase tobacco products, or receive or possess an order. We use AgeChecker.Net to verify age and identity. You agree to provide accurate information and complete required verification. We may refuse or cancel an order when verification is unsuccessful, information appears inaccurate, or we reasonably suspect a purchase is intended for anyone under 21.
PRODUCTS, PRICES, AND AVAILABILITY
We make reasonable efforts to display product descriptions, images, prices, and availability accurately. Natural tobacco products can vary in color, appearance, and construction. We may correct errors, change prices, limit quantities, discontinue products, or refuse sales when permitted by law.
ORDERS, BILLING, AND CANCELLATIONS
You agree to provide current, complete, and accurate order, payment, contact, and shipping information. Submission of an order does not guarantee acceptance. We may decline or cancel an order because of inventory, payment, fraud, age-verification, address, shipping, tax, legal, or compliance concerns.
Customers may request cancellation before fulfillment as described in our Return and Refund Policy. Once an order has been packed, fulfilled, or shipped, it cannot be canceled. Approved refunds are returned to the original payment method.
SHIPPING DESTINATIONS AND EXPORT RESTRICTIONS
We ship through USPS only to eligible street addresses in Alabama, Arkansas, Florida, Georgia, Kansas, Kentucky, Mississippi, Missouri, Montana, Nebraska, New Jersey, New Mexico, North Dakota, South Carolina, Tennessee, Texas, West Virginia, and Wyoming.
We do not ship to any other state, the District of Columbia, U.S. territories or associated jurisdictions, international destinations, PO boxes, or APO, FPO, or DPO addresses. We do not accept international or export orders.
Products purchased from us may not be exported, redirected, reshipped, transferred, or purchased for delivery to a person or location where the sale, possession, or delivery would be unlawful or outside our eligible shipping destinations. Purchases are for lawful personal use only and may not be made for unauthorized resale.

TOBACCO AND HEALTH NOTICE
Cigars contain nicotine, an addictive substance. Tobacco use carries serious health risks. You are responsible for using, storing, and possessing products lawfully and for keeping them away from minors.
ACCOUNTS AND SITE SECURITY
If you create an account, you are responsible for maintaining the confidentiality of your credentials and for activity conducted through your account. You may not attempt to bypass age verification, security controls, checkout restrictions, or shipping restrictions.

You may not use the site for unlawful, fraudulent, abusive, harmful, or infringing activity; submit false information; interfere with site security or operation; introduce malicious code; scrape or misuse personal information; impersonate another person; or violate tobacco, age, shipping, export, or consumer-protection laws.

We do not guarantee uninterrupted or error-free access, exact product appearance, or delivery by a particular date. Nothing in these Terms excludes warranties or rights that cannot legally be excluded.
LIMITATION OF LIABILITY
To the maximum extent permitted by law, Big Dave's Cigars and its owners, employees, and service providers will not be liable for indirect, incidental, special, punitive, or consequential damages arising from use of the site or products. Our total liability relating to an order will not exceed the amount paid for that order, except where a different limitation is required by law.
INDEMNIFICATION
You agree to indemnify and hold Big Dave's Cigars harmless from third-party claims, losses, or expenses arising from your unlawful use of the site, violation of these Terms, or infringement of another person's rights, to the extent permitted by law.
GOVERNING LAW
These Terms and purchases from Big Dave's Cigars are governed by the laws of the State of Texas, without regard to conflict-of-law principles, except where applicable consumer law requires otherwise.
